POWERS AND DUTIES OF THE ADENA MUNICIPAILTY
Village Council - The legislative authority of a village rests in its council. Most powers and duties of a village council are set forth in Ohio Revised Code Chapters 705, 731 and 733.
The council consists of six electors who must reside in the village for one year preceding their election. They may not hold any other public employment or have any
interest in any contract with the village. Council members are elected for terms of four years at salaries fixed by the council itself.
The Mayor is the chief executive of the village. The mayor supervises the administration of the village and presides at council meetings.
The mayor may appoint various village officials and is elected for a term of four years.
The President Pro-Tempore is a member of village council who is elected to this office at the first January meeting each year to serve as president in the mayor's absence. If the mayor becomes permanently absent from office, the president pro tempore fills that office until a successor can be elected to the unexpired term.
The Village Clerk-Treasurer, is a combined office of the village clerk and the treasurer into one office. The clerk is the chief fiscal officer of the village and the clerk for village council. The clerk must be an elector of the village and is elected to a term of four years.
The Clerk of Courts is a position established by the Mayor and performs all other duties required by the Mayor or by Ordinance. The clerk of
courts coordinates directs, and appraises the administrative functions of the Mayor's courts, is responsible for all court records, receipts, fines, postings, and filings
of all matters pertaining to Mayor's Court. The Clerk of court also maintains the Mayor's Court account balancing and forwarding money of the court to the Director
of Finance (Clerk-Treasurer) for the General Fund.
The village council must establish a Board of Trustees for Public Affairs made up of three residents whenever the village is involved in a public utility.
The members elect a president and a clerk. The clerk is not a board member. If a board members moves from the village, the member can no longer continue the
term of office and therefore must resign. This BPA executes duties relative to the utility services, operates the utilities, and manages the sewer system. The village council makes major policy decisions regarding the village utilities and must authorize large expenditures as well as establishing water rates. The administration is under general supervision and control of the mayor.
Each village is required to have a Marshal designated "chief of police" appointed by the mayor with council approval, to serve until removal from office.
The marshal may only be removed for cause, and the mayor must file written charges with the village council and serve the marshal to be heard before village council.
Appeals may be taken to village council and the common pleas court.
